Using DISCO’s Copyrighted Materials

DISCO CORPORATION and each company belonging to the DISCO group create various copyrighted materials, works, and documents through the process of business activities.

DISCO thinks that the wide usage of these copyrighted materials, works, and documents under appropriate conditions is beneficial not only to DISCO, but also to society and all relevant stakeholders.
Therefore, DISCO has formulated a “Terms of Use of DISCO Copyrighted Materials” to act as a guide when using DISCO’s copyrighted materials, works, and documents.

You can use DISCO’s copyrighted materials, works, and documents as long as you read and comply with the following terms and conditions.

Terms of Use of DISCO Copyrighted Materials

This Terms of Use of DISCO Copyrighted Materials (hereinafter referred to as “Terms”) stipulates the items that apply when using the materials, works, and documents (hereinafter referred to as “DISCO Copyrighted Materials”) that are copyrighted by DISCO CORPORATION (hereinafter referred to as “DISCO,” and includes all companies in the DISCO group). The contents of the Terms may be changed without any prior notice. When using DISCO Copyrighted Materials, please refer to the contents of the latest version of the Terms. The use of DISCO Copyrighted Materials shall be deemed as acceptance of the Terms (including updated Terms if changed).

Please note that the following DISCO Copyrighted Materials shall not be used unless special permission has been obtained from DISCO.

  • Materials, works, and documents that include confidential information (information that is indicated as being confidential, or information that was specified as being confidential)
  • Materials, works, and documents that include personal information (photographs, videos, or voice recordings that can be used to identify an individual)
  • Program works
Chapter 1: Definitions

Article 1 (Definitions)

(1)
Client – shall mean customers and suppliers who are doing business or considering doing business with DISCO.
(2)
General User – shall mean all persons, companies, and entities who are not Clients.
(3)
Disclosed Materials – shall mean DISCO Copyrighted Materials that DISCO has disclosed to the general public and that can be accessed or obtained without restrictions (does not include materials, works, and documents that require an account and password registration to be accessed or obtained).
(4)
Undisclosed Materials – shall mean DISCO Copyrighted Materials that are not Disclosed Materials. Includes copyrighted materials, works, and documents that require an account and password registration to be accessed or obtained, manuals, specifications, reports, and materials provided by DISCO that accompany a DISCO product or service, and copyrighted materials, works, and documents that were created for a specific Client.
(5)
Internal Use – shall mean the use of DISCO Copyrighted Materials by a Client only within the company and within the scope necessary to purchase or use (also includes considering purchase or use) DISCO products or services.

Chapter 2: Conditions of Use

Regarding the use of DISCO Copyrighted Materials, check the conditions of use stipulated for each type of User (Client, General User), type of Material (Disclosed Materials, Undisclosed Materials), and Purpose/Range of use (Internal Use, Other than Internal Use, etc.).

Clause 1: Use by a Client
Article 2 (Use of Disclosed Materials)
1. If a Client is to use Disclosed Materials for “Internal Use,” the Client shall comply with all the following Conditions of Use.
Conditions of Use
(1)
The Client shall not grant permission to a third party to use DISCO Copyrighted Materials
(2)
The Client shall not obtain any rights (includes registration of copyrights, trademarks, and design rights) regarding the DISCO Copyrighted Materials, and shall not use the DISCO Copyrighted Materials in the Client’s own or a third party’s logo or character
(3)
The Client shall not obtain any direct profit as a result of using DISCO Copyrighted Materials
(Obtaining direct profit refers to acts such as selling DISCO Copyrighted Materials to a third party or using it for the Client’s own or a third party’s products or services)
(4)
The Client shall not use DISCO Copyrighted Materials, directly or indirectly, in its or a third party’s business operations related to DISCO’s (includes DISCO’s subsidiaries and related companies) competitors
(5)
The Client shall not use DISCO Copyrighted Materials under terms that are not appropriate from a societal standpoint or under terms that go against public order and morals (includes use related to antisocial forces, and illegal acts)
(6)
The Client shall not use DISCO Copyrighted Materials in a way that damages DISCO’s reputation or causes any disadvantages to DISCO
(7)
The Client shall not use DISCO Copyrighted Materials in election activities, political activities, and religious activities, or under terms that make it seem like DISCO supports or goes against certain policies, ideologies, or thoughts
(8)
The Client shall not violate applicable laws and regulations, and shall not infringe on a third party’s rights
2. If a Client is to use Disclosed Materials for “Other than Internal Use,” the Client shall comply with all the following Conditions of Use.
Conditions of Use
(1)
The Client shall clearly mention that the materials are DISCO Copyrighted Materials and mention the source
(2)
The Client shall not modify or edit DISCO Copyrighted Materials (includes partial quotations)
(3)
The Client shall not grant permission to a third party to use DISCO Copyrighted Materials
(4)
The Client shall not obtain any rights (includes registration of copyrights, trademarks, and design rights) regarding the DISCO Copyrighted Materials, and shall not use the DISCO Copyrighted Materials in the Client’s own or a third party’s logo or character
(5)
The Client shall not obtain any direct profit as a result of using DISCO Copyrighted Materials
(Obtaining direct profit refers to acts such as selling DISCO Copyrighted Materials to a third party or using it for the Client’s own or a third party’s products or services)
(6)
The Client shall not use DISCO Copyrighted Materials, directly or indirectly, in its or a third party’s business operations related to DISCO’s (includes DISCO’s subsidiaries and related companies) competitors
(7)
The Client shall not use DISCO Copyrighted Materials under terms that are not appropriate from a societal standpoint or under terms that go against public order and morals (includes use related to antisocial forces, and illegal acts)
(8)
The Client shall not use DISCO Copyrighted Materials in a way that damages DISCO’s reputation or causes any disadvantages to DISCO
(9)
The Client shall not use DISCO Copyrighted Materials in election activities, political activities, and religious activities, or under terms that make it seem like DISCO supports or goes against certain policies, ideologies, or thoughts
(10)
The Client shall not violate applicable laws and regulations, and shall not infringe on a third party’s rights
Article 3 (Use of Undisclosed Materials)
1. If a Client is to use Undisclosed Materials for “Internal Use,” the Client shall comply with all the following Conditions of Use.
Conditions of Use
(1)
The Client shall mention that the DISCO Copyrighted Materials are “Internal Only”
(2)
The Client shall not grant permission to a third party to use DISCO Copyrighted Materials
(3)
The Client shall not obtain any rights (includes registration of copyrights, trademarks, and design rights) regarding the DISCO Copyrighted Materials, and shall not use the DISCO Copyrighted Materials in the Client’s own or a third party’s logo or character
(4)
The Client shall not obtain any direct profit as a result of using DISCO Copyrighted Materials
(Obtaining direct profit refers to acts such as selling DISCO Copyrighted Materials to a third party or using it for the Client’s own or a third party’s products or services)
(5)
The Client shall not use DISCO Copyrighted Materials, directly or indirectly, in its or a third party’s business operations related to DISCO’s (includes DISCO’s subsidiaries and related companies) competitors
(6)
The Client shall not use DISCO Copyrighted Materials under terms that are not appropriate from a societal standpoint or under terms that go against public order and morals (includes use related to antisocial forces, and illegal acts)
(7)
The Client shall not use DISCO Copyrighted Materials in a way that damages DISCO’s reputation or causes any disadvantages to DISCO
(8)
The Client shall not use DISCO Copyrighted Materials in election activities, political activities, and religious activities, or under terms that make it seem like DISCO supports or goes against certain policies, ideologies, or thoughts
(9)
The Client shall not violate applicable laws and regulations, and shall not infringe on a third party’s rights
2. If a Client is to use Undisclosed Materials as citations in the Client’s product’s manuals or sales promotion materials, the Client shall comply with all the following Conditions of Use.

The Client shall clearly mention that the materials, works, and documents are DISCO Copyrighted Materials and mention the source
(2)
The Client shall not modify and edit DISCO Copyrighted Materials (includes partial quotations)
(3)
The Client shall not grant permission to a third party to use DISCO Copyrighted Materials
(4)
The Client shall not obtain any rights (includes registration of copyrights, trademarks, and design rights) regarding the DISCO Copyrighted Materials, and shall not use the DISCO Copyrighted Materials in the Client’s own or a third party’s logo or character
(5)
The Client shall not obtain any direct profit as a result of using DISCO Copyrighted Materials
(Obtaining direct profit refers to acts such as selling DISCO Copyrighted Materials to a third party or using it for the Client’s own or a third party’s products or services)

The Client shall not use DISCO Copyrighted Materials, directly or indirectly, in its or a third party’s business operations related to DISCO’s (includes DISCO’s subsidiaries and related companies) competitors
(7)
The Client shall not use DISCO Copyrighted Materials under terms that are not appropriate from a societal standpoint or under terms that go against public order and morals (includes use related to antisocial forces, and illegal acts)

The Client shall not use DISCO Copyrighted Materials in a way that damages DISCO’s reputation or causes any disadvantages to DISCO
(9)
The Client shall not use DISCO Copyrighted Materials in election activities, political activities, and religious activities, or under terms that make it seem like DISCO supports or goes against certain policies, ideologies, or thoughts

The Client shall not violate applicable laws and regulations, and shall not infringe on a third party’s rights
Clause 2: Use by a General User
Article 4 (Use of Disclosed Materials)
If a General User is to use Disclosed Materials, the General User shall comply with all the following Conditions of Use.

The General User shall clearly mention that the materials, works, and documents are DISCO Copyrighted Materials and mention the source
(2)
The General User shall not modify and edit DISCO Copyrighted Materials (includes partial quotations)
(3)
The General User shall not grant permission to a third party to use DISCO Copyrighted Materials
(4)
The General User shall not obtain any rights (includes registration of copyrights, trademarks, and design rights) regarding the DISCO Copyrighted Materials, and shall not use the DISCO Copyrighted Materials in the General User’s own or a third party’s logo or character
(5)
The General User shall not obtain any direct profit as a result of using DISCO Copyrighted Materials
(Obtaining direct profit refers to acts such as selling DISCO Copyrighted Materials to a third party or using it for the General User’s own or a third party’s products or services)
(6)
The General User shall not use DISCO Copyrighted Materials, directly or indirectly, in its or a third party’s business operations related to DISCO’s (includes DISCO’s subsidiaries and related companies) competitors
(7)
The General User shall not use DISCO Copyrighted Materials under terms that are not appropriate from a societal standpoint or under terms that go against public order and morals (includes use related to antisocial forces, and illegal acts)
(8)
The General User shall not use DISCO Copyrighted Materials in a way that damages DISCO’s reputation or causes any disadvantages to DISCO
(9)
The General User shall not use DISCO Copyrighted Materials in election activities, political activities, and religious activities, or under terms that make it seem like DISCO supports or goes against certain policies, ideologies, or thoughts
(10)
The General User shall not violate applicable laws and regulations, and shall not infringe on a third party’s rights
Chapter 3: General Terms and Conditions
Article 5 (Non-renouncement of the Author’s Moral Rights, etc.)
1.
Unless clearly stipulated in this Terms, DISCO does not grant any rights or licenses whatsoever.
2.
DISCO reserves the right to stop the user’s use of DISCO Copyrighted Materials at any time without bearing any responsibilities whatsoever. In this case, the user shall comply with DISCO’s instructions.
3.
All rights related to DISCO Copyrighted Materials belong to DISCO. DISCO will not renounce any rights including the right of the author to exercise their moral rights with regard to DISCO Copyrighted Materials.
4.
In case any conditions of use are stipulated by DISCO in DISCO’s websites, the DISCO Copyrighted Materials itself, or along with the DISCO Copyrighted Materials, or in case a separate agreement with DISCO exists, the user shall use the DISCO Copyrighted Materials according to and comply with the appropriate conditions thereof.
Article 6 (Exemption from Liability)
DISCO shall not be responsible for any acts, losses, or damages that may arise related to the use of DISCO Copyrighted Materials.
Article 7 (Governing Law)
This Terms shall be governed and construed in accordance with the laws of Japan. The users hereby consent to the exclusive first instance jurisdiction of the Tokyo District Court for all disputes, controversies, or differences that may arise between the users and DISCO in connection with this Terms.
